Terms of Service

Effective June 12, 2026 · Last updated June 12, 2026

Welcome to Mooday. These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and the team behind Mooday ("Mooday", "we", "us", or "our") and govern your access to and use of the Mooday mobile application and related services (together, the "Service").

Please read these Terms carefully. By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By downloading, accessing, or using Mooday, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of another person, you represent that you are authorized to accept these Terms on their behalf.

We may update these Terms from time to time as described in Section 12. Your continued use of the Service after an update means you accept the revised Terms.

2. Eligibility and Account Responsibilities

You must be at least 16 years old, or the minimum age of digital consent in your country, to use Mooday. If you are under the age required to manage your own account, you may only use the Service with the consent and supervision of a parent or legal guardian.

To use certain features you may need to create an account. You agree to:

  • Provide accurate and complete information when registering.
  • Keep your login credentials confidential and secure.
  • Be responsible for all activity that occurs under your account.
  • Notify us promptly at admin@mooday.app if you suspect any unauthorized use of your account.

You are responsible for any devices, networks, and data charges required to access the Service.

3. Acceptable Use

Mooday is provided for your personal, non-commercial use to record and reflect on your moods and experiences. You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Upload content that is illegal, abusive, or infringes the rights of others.
  • Attempt to access, tamper with, or disrupt the Service, its servers, or other users' data.
  • Reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by applicable law.
  • Use automated systems to access the Service in a way that sends more requests than a human could reasonably produce.
  • Resell, sublicense, or commercially exploit the Service without our written permission.

For more detail on what you may and may not post, see our User Content Guidelines.

We may investigate and take appropriate action against any violation of this section, including the steps described in Section 8.

4. Your Content and Ownership

Mooday lets you create personal content such as mood entries, intensity ratings, activity tags, notes, photos, and voice memos ("Your Content").

You own Your Content. We do not claim ownership of it. You grant us only the limited license needed to operate the Service - for example, to store, back up, sync across your devices, and display Your Content back to you. We do not sell Your Content, and we do not use the substance of your personal journal entries for advertising.

You are responsible for Your Content and for ensuring you have the right to store any material (such as photos) that you add to the Service. You can delete Your Content at any time within the app; deletion is processed as described in our Privacy Policy.

5. Mooday Intellectual Property and License

The Service - including the app, its design, illustrations, logos, text, and software - is owned by Mooday or its licensors and is protected by intellectual property laws. Nothing in these Terms transfers any of those rights to you.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Service on devices you own or control, solely for your personal use.

The names "Mooday", our logo, and other brand features are our trademarks. You may not use them without our prior written consent.

6. Free and Premium Access

Mooday offers both free features and paid "Premium" features. We may change which features are free or Premium over time.

Premium features are offered through a subscription or other purchase. The price, billing cycle, renewal, and cancellation terms for any purchase are presented to you at the point of sale and are handled by the applicable app store (such as the Apple App Store or Google Play). Those store terms, together with any Premium terms presented at purchase, govern payment, renewals, and refunds. These Terms do not duplicate or override those payment rules.

If you do not maintain an active Premium subscription, Premium features may become unavailable, but you will keep access to the free features and to Your Content.

7. Service Availability and Changes

We work to keep Mooday available and reliable, but we provide the Service on an "as available" basis. Mooday is designed to work offline, with your data syncing to our cloud backend when you are online.

We may modify, suspend, or discontinue any part of the Service at any time, including features, content, and supported platforms. Where reasonably possible, we will give notice of significant changes. We are not liable for any unavailability, maintenance, or change to the Service, subject to the limits set out in applicable law.

8. Termination and Account Restriction

You may stop using the Service and delete your account at any time.

We may suspend, restrict, or terminate your access to the Service if you breach these Terms, if required by law, or to protect the Service or other users. Where appropriate and lawful, we will give you notice and an opportunity to resolve the issue first.

On termination, your license to use the Service ends. Provisions that by their nature should survive termination - including ownership, disclaimers, limitation of liability, and governing law - will continue to apply.

9. Disclaimers

Mooday is a self-reflection and journaling tool. It is not a medical device and does not provide medical, psychological, or mental-health advice, diagnosis, or treatment. Mooday helps you reflect on your emotions; it does not diagnose or treat them. If you are experiencing a mental-health crisis or need urgent support, contact a qualified professional or your local emergency services.

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by law, Mooday and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service.

To the extent we are found liable, our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (b) USD 50.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing Law

These Terms are governed by the laws of Singapore, without regard to its conflict of laws principles. You and Mooday agree to submit to the exclusive jurisdiction of the courts located in Singapore to resolve any dispute arising out of or relating to these Terms or the Service.

<!-- TO CONFIRM with legal before final review: governing-law jurisdiction and dispute-resolution venue. -->

12. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice within the app. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
